The Madhya Pradesh High Court has given a big decision in the OBC reservation case. Hearing all the petitions filed in the 27 percent OBC reservation case, the High Court has refused to increase the OBC reservation beyond 14 percent at present. 

Recruitment will be done on the basis of 14% reservation only. All the recruitment processes which are stalled in the health department should also be done at the rate of 14 percent.

OBC RESERVATION.

At present, the High Court has directed to keep only 13 percent of the reservation in reserve. The next hearing in this matter will be held in the court on July 10. 

Significantly, all the petitions filed in the Madhya Pradesh High Court regarding the increased OBC reservation were heard today. In which the double bench of High Court Chief Justice Mohammad Rafiq and Justice Vijay Shukla has given this decision. Now in this matter on July 10, all the parties in which all the parties have to present a written argument. After that the court may give its final verdict.

If 27% reservation is given to Other Backward Classes in Madhya Pradesh, then the percentage of reservation in the state will be more than 50. In the year 1992, the Supreme Court, while delivering the verdict in the Indira Sawhney case, had fixed the maximum limit of reservation at 50 percent.

But on Tuesday, on the basis of the Indira Sawhney case in the High Court, it was said on behalf of the state government that the Supreme Court has also agreed that the percentage of reservation can be increased to more than 50 in special circumstances. However, the court has not accepted it yet.

Before March 2019, a total of 50 percent seats, reserved and the same number of seats were unreserved, including the reservation of all classes in the state level examinations. Congress’s Kamal Nath government came to power in December 2018. In his manifesto, he had talked about increasing the OBC reservation to 27 percent. Which was implemented by his government in 2019 after coming to power.

The Kamal Nath government had made the law, as soon as the Kamal Nath government came, the reservation limit in government jobs was increased from 27 percent to 63 percent, which is a violation of the Supreme Court. Let us inform that a law was made for the Backward Classes (OBC) from 14 percent to 27 percent reservation. After which many organizations and BJP challenged it in the High Court.

In fact, due to the ongoing hearing in the High Court on the issue of reservation, the recruitments in the government departments of the state are currently banned. However, now the court has made it clear that the recruitment should be done on the basis of 14 percent reservation only.
